With financial crime compliance a permanent fixture as an FCA priority, and the FATF Mutual Evaluation of the UK in early 2018, firms are increasingly under scrutiny to show that their controls are up to scratch.

A Skilled Person review (s.166) or a Monitorship following a deferred prosecution agreement are key tools in a regulator’s or law enforcement’s tool box. Such financial crime reviews can put firms under huge pressure from a resource and financial perspective. Our March briefing will focus on exploring these two tools. We will explain the similarities and differences, as well as offering practical guidance around how to navigate them, and importantly, considerations as to how not to find yourself under the scrutiny in the first place.
