NEWSLETTER: Recent FCA publications show a strong investor protection theme. Finalised guidance in relation to vulnerable customers, warnings around young investors taking on big financial risks and plans to review the financial promotion regime relating to certain kinds of high risk investment are all part of a clear direction of travel. Controls around suitability, appropriateness and financial promotions need to remain high on firms’ agendas.

As the EU makes changes to MiFID relating to smaller company research and best execution reports, the FCA is considering whether to do the same. Its recent consultation, which is considered and proportionate, proposes going further than the EU has in relation to the relaxation of the relevant rules, demonstrating that it it is not afraid to diverge from EU rulemaking where it makes sense to do so.
